User Agreement

1. What This Agreement Covers
This user agreement applies to the websites, apps, games, software, online features, customer support tools, and related digital services provided by Luminix Play Limited. In this document, those offerings are called the "Service."
When this agreement says "Luminix Play," "we," "us," or "our," it means Luminix Play Limited. When it says "you" or "user," it means the person or organization using the Service.
Using the Service, registering an account, downloading our software, or completing a purchase means that you agree to follow this agreement. If you do not agree, do not use the Service.
2. Age, Authority, and Local Law
You must be old enough to use online services in your country or region and must be able to form a binding agreement. The Service is not intended for children under 13.
A user who is 13 or older but still a minor must have permission from a parent or legal guardian. The adult giving permission accepts responsibility for the minor's activity, communications, purchases, and compliance with this agreement.
You are responsible for making sure that your use of the Service is lawful where you access it. We may restrict access where we consider it necessary for legal, safety, or operational reasons.
3. Your Account
Some parts of the Service may require an account. Account information must be truthful, complete, and kept up to date. You should not choose a username, display name, or profile detail that impersonates someone else, violates rights, or is likely to offend or mislead other users.
Keep your password and sign-in methods private. You are responsible for activity on your account unless the activity was caused by a security failure on our side. If you notice suspicious access, contact us as soon as possible.
Accounts are not commodities. You may not sell, rent, lend, transfer, trade, or broker access to an account unless Luminix Play has expressly allowed that through an official feature.
4. Permission to Use the Service
We give you a personal, limited, non-exclusive, revocable permission to use the Service for lawful entertainment and ordinary personal use. This permission lasts only while you comply with this agreement and any feature-specific rules.
No ownership rights are transferred to you. Software, game elements, audiovisual materials, characters, names, logos, interfaces, code, data compilations, and other materials remain owned by Luminix Play or the relevant rights holder.
5. Service Rules
You must use the Service fairly and respectfully. The following activity is not allowed:
- attempting to reverse engineer, copy, modify, translate, decompile, or create unauthorized versions of the Service;
- using hacks, unauthorized mods, bots, emulators, macros, exploit tools, or other methods that distort normal play or service operation;
- interfering with networks, servers, security controls, account systems, payment flows, or usage limits;
- scraping, mining, harvesting, or bulk-collecting data from the Service without written approval;
- posting or transmitting illegal, threatening, abusive, hateful, sexually exploitative, defamatory, fraudulent, or rights-infringing material;
- using the Service to advertise, spam, phish, launder value, run scams, or conduct commercial activity without our written consent.
6. Community Material and Feedback
You may be able to submit names, chat, comments, images, gameplay materials, reviews, suggestions, bug reports, or other material through the Service. You must have the rights needed to provide that material and must not submit anything unlawful or harmful.
For material you submit, you allow Luminix Play to store, host, display, reproduce, adapt, remove, moderate, distribute, and use it as reasonably needed to provide, secure, improve, and promote the Service. This permission is worldwide, non-exclusive, royalty-free, and sublicensable.
We may remove or limit community material, account features, or communications if we believe they breach this agreement, create risk, or harm the experience of other users. We are not required to review every submission before it appears.
7. Digital Items and Paid Features
The Service may include coins, points, subscriptions, access passes, boosts, cosmetics, unlocks, bonus content, or other digital features. These are licensed features for use inside the Service and are referred to here as "Digital Items."
Digital Items are not cash, bank balances, securities, stored value, or property that can be redeemed from us. They do not carry real-world monetary value and may not be sold, exchanged, or transferred outside official Service functionality.
We may adjust, expire, rebalance, rename, suspend, or discontinue Digital Items, including for product design, security, compliance, technical, or business reasons. To the fullest extent allowed by law, no compensation is owed for these changes.
8. Payments and Refund Handling
Payments may be handled by app stores, payment processors, marketplaces, or other third parties. Their own terms can apply to billing, refunds, taxes, currency conversion, identity checks, and chargebacks.
Before confirming a purchase, check the price, item description, account, and payment method. You confirm that you are authorized to use the payment method selected.
Unless the law or the relevant third-party platform requires otherwise, completed purchases are final. If access is suspended or an account is closed because of a breach of this agreement, unused paid features or Digital Items may be lost without refund.
9. Intellectual Property Notices
Luminix Play and its licensors retain all rights in the Service and all related intellectual property. You may not remove copyright, trademark, attribution, security, or ownership notices from any part of the Service.
You must not use our company name, product names, artwork, logos, screenshots, or other brand assets in a way that suggests affiliation, sponsorship, or approval unless we have given written permission.
If you send ideas, suggestions, or reports to us, we may use them without paying you or treating them as confidential, unless we have separately agreed otherwise in writing.
10. Availability, Updates, and Third-Party Services
The Service may change over time. We may add, remove, test, patch, suspend, or replace features, content, rules, or access methods. Some changes may be required quickly for safety, security, legal compliance, or service stability.
The Service may interact with third-party platforms, stores, devices, networks, analytics tools, advertising partners, or login providers. We are not responsible for third-party services that we do not control, and their terms and privacy practices may apply.
11. Privacy and Safety
Personal information is handled according to the privacy notice or privacy policy made available for the Service. You should review that notice to understand what information may be collected and how it may be used.
Do not share sensitive personal details about yourself or others through public areas of the Service. If you provide information about another person, you must have a lawful basis and any consent required to do so.
12. No Service Warranty
To the fullest extent permitted by law, the Service is made available "as is" and "as available." We do not promise that it will be uninterrupted, error-free, fully secure, compatible with every device, or available in every location.
We disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment, except where such disclaimers are not allowed by law.
13. Liability Limits
Nothing in this agreement limits liability that cannot legally be limited. Subject to that rule, Luminix Play, its officers, employees, contractors, affiliates, licensors, and service providers will not be responsible for indirect, incidental, special, punitive, exemplary, or consequential losses.
This includes loss of data, profits, revenue, business, goodwill, anticipated savings, or service access, even if we were told that such losses were possible.
To the maximum extent allowed by law, our total liability connected with the Service or this agreement will be limited to the higher of HKD 1,000 or the amount you paid directly to Luminix Play for the Service during the six months before the event giving rise to the claim.
14. Your Responsibility to Cover Claims
You agree to cover Luminix Play and its officers, employees, contractors, affiliates, licensors, and service providers against claims, losses, damages, liabilities, costs, and reasonable legal fees that arise from your misuse of the Service, your submitted material, your breach of this agreement, or your violation of law or third-party rights.
15. Ending or Restricting Access
You may stop using the Service at any time. Where account deletion or closure tools are available, you may use them subject to any retention needed for legal, security, anti-fraud, accounting, backup, or dispute purposes.
We may suspend, limit, or terminate access if we believe there has been a breach, fraud, payment abuse, security risk, unlawful conduct, rights infringement, or other harm to users, Luminix Play, or the Service.
Terms dealing with ownership, payments, Digital Items, submitted material, warranty disclaimers, liability limits, indemnity, governing law, and other provisions intended to continue will survive the end of your access.
16. Changes to This Agreement
We may revise this agreement when the Service, laws, business practices, or safety needs change. The latest version may be posted on our website or shown through the Service.
If a change is material, we will use reasonable efforts to give notice. Continuing to use the Service after the effective date of an updated agreement means that you accept the updated terms.
17. Hong Kong Law and Disputes
This agreement is governed by the laws of Hong Kong, excluding conflict-of-law rules. Mandatory consumer protections in your place of residence may still apply where they cannot be waived.
Before either side begins a formal claim, the parties should try in good faith to resolve the matter through written notice and discussion for 30 days, unless urgent relief is reasonably needed.
Subject to non-waivable consumer rights, the courts of Hong Kong will have exclusive jurisdiction over disputes connected with this agreement or the Service.
18. General Terms and Contact
If part of this agreement is invalid or unenforceable, the remaining parts will continue to apply. Our decision not to enforce a term immediately is not a waiver of our right to enforce it later.
You may not transfer this agreement without our written approval. We may transfer it in connection with a merger, acquisition, restructuring, sale of assets, or other lawful business transfer.
